Media Kit Terms of Use

These Media Kit Terms of Use are incorporated into and form part of the Sublime Vitality Terms of Service.
The Sublime Vitality Media Kit (“Media Kit”) allows licensed healthcare providers to generate, customize, and distribute educational materials about compounded wellness products. These Media Kit Terms of Use (“MK Terms”) govern all materials accessed through or generated by the Media Kit, including patient education guides, waiting room posters, physician information sheets, and social graphics.
You are solely responsible for reviewing all Media Kit materials for accuracy, compliance, and appropriateness before distributing them to patients, staff, or the public. Sublime Vitality does not review or approve physician-customized materials before distribution.
1. License Grant
Sublime Vitality grants you a limited, non-exclusive, revocable license to use Media Kit materials solely for the following purposes within your licensed medical practice:
- Distributing educational materials to patients currently under your care;
- Displaying informational content in your practice’s waiting room or clinical areas;
- Sharing educational content through your practice’s professional communication channels; and
- Providing product information to staff for internal training purposes.
This license does not include the right to:
- Resell, sublicense, or transfer Media Kit materials to any other person or entity;
- Modify product descriptions, compound names, or clinical information except through the Media Kit’s designated customization fields;
- Use materials to advertise or promote products to the general public through mass media channels without appropriate disclosures; or
- Present materials in a manner that implies FDA approval or regulatory clearance of any compounded product.
2. Required Disclosures — Your Obligation
All patient-facing materials generated through the Media Kit include required compliance disclaimers. You must not remove, obscure, alter, or minimize these disclosures. Required disclosures include:
- A statement that the product is a compounded pharmaceutical and has not been approved, cleared, or licensed by the FDA;
- A statement that the material is for educational purposes only and does not constitute medical advice; and
- Your practice name and contact information (where applicable).
If you generate materials for compounds that are in draft or pending compliance review status within the Platform, you must obtain independent legal or compliance review before distributing those materials. Contact privacy@sublimevital.com for current compound approval status.
3. Prohibited Claims and Content
When using Media Kit materials, you must not:
- State or imply that any compounded product is “FDA-approved,” “FDA-cleared,” or equivalent to any FDA-approved drug;
- Use the names of branded FDA-approved drugs (e.g., Ozempic, Wegovy, Mounjaro) to describe or promote compounded products, including language such as “same as,” “compounded version of,” or “generic form of”;
- Make absolute efficacy claims (“proven to,” “guaranteed,” “clinically proven”) for compounded products without adequate scientific substantiation;
- Use patient testimonials in conjunction with Media Kit materials without complying with FTC endorsement guidelines and applicable state regulations;
- Represent that any compounded product is safe for use without individual physician evaluation; or
- Make any claim that violates your state medical board’s advertising regulations or ethical rules.
4. Your Compliance Responsibility
As a licensed healthcare provider, you are solely responsible for ensuring that your use of Media Kit materials complies with:
- Federal Trade Commission (FTC) health advertising guidelines and the FTC Act, 15 U.S.C. § 45;
- FDA regulations regarding promotion of unapproved drugs and compounded products;
- Your state medical board’s advertising, marketing, and professional conduct rules;
- The rules of any professional association to which you belong;
- State consumer protection and deceptive trade practices laws; and
- HIPAA requirements if you distribute materials in conjunction with patient-specific communications.
Sublime Vitality recommends that you have patient-facing materials reviewed by qualified legal counsel before distribution, particularly in states with heightened compounding regulations (including, without limitation, California, Mississippi, Tennessee, and Texas).
5. Intellectual Property in Materials
All underlying content in Media Kit materials — including compound descriptions, scientific summaries, educational text, and graphic design elements — is owned by or licensed to Sublime Vitality. Your practice branding (logo, colors, practice name) that you incorporate via the Media Kit remains your property.
You do not acquire any ownership interest in the underlying Media Kit content by generating customized materials. Materials generated through the Media Kit are licensed for use as described in Section 1 and may not be repurposed outside the scope of that license.
6. Disclaimer of Liability for Patient-Facing Use
Sublime Vitality provides Media Kit materials as a professional resource tool for licensed healthcare providers. We are not responsible for how you use, distribute, or present these materials to patients or the public.
SUBLIME VITALITY EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY CLAIM, DAMAGE, LOSS, OR CONSEQUENCE ARISING FROM:
- A PATIENT’S RELIANCE ON EDUCATIONAL MATERIALS YOU DISTRIBUTE;
- ANY REGULATORY ACTION, PROFESSIONAL DISCIPLINE, OR LEGAL CLAIM RESULTING FROM YOUR USE OF MEDIA KIT MATERIALS;
- INACCURACIES, OMISSIONS, OR OUTDATED INFORMATION IN MATERIALS AFTER THE DATE OF GENERATION;
- YOUR FAILURE TO INCLUDE OR MAINTAIN REQUIRED COMPLIANCE DISCLOSURES; OR
- YOUR VIOLATION OF THESE MK TERMS OR APPLICABLE LAW.
7. Content Updates and Accuracy
Compound information, research summaries, and educational content in the Media Kit are updated periodically. Materials you have previously generated and distributed may not reflect the most current information. You are responsible for periodically reviewing and refreshing patient-facing materials to ensure they reflect current compound status and available research.
Sublime Vitality does not guarantee the accuracy, completeness, or current applicability of any information in Media Kit materials and is not responsible for clinical outcomes associated with reliance on such materials.
8. Suspension and Termination of License
Sublime Vitality may immediately suspend or revoke your Media Kit license if you:
- Use materials in violation of these MK Terms or applicable law;
- Distribute materials containing claims that expose Sublime Vitality to regulatory or legal risk;
- Your physician platform account is suspended or terminated; or
- We are required to do so by law or regulatory directive.
Upon revocation, you must immediately cease distributing Media Kit materials. Copies previously distributed to patients are not subject to recall.
